STATEMENT OF FACTS:
1.  Ordinance 10454 and K.C.C. chapter 2.58 established an emergency regional radio communications ("the system").  The system has been constructed and is in use by the entities described in K.C.C. chapter 2.58, including the city of Seattle ("Seattle"), the Eastside Public Safety Communications Agency ("EPSCA") and the Valley Communications Center ("ValleyCom").
2.  The Snohomish County Emergency Radio System ("SERS"), a legal public entity operating in Snohomish county, has installed a similar radio system, which it owns and operates.
3.  The city of Tacoma ("Tacoma") has installed a similar radio system, which it owns and operates.
4.  The Port of Seattle ("the Port") has installed and operates a similar radio system.
5.  Seattle, acting under the sponsorship of the King County regional communications board, applied for and was awarded a grant to replace the central zone controllers in the radio networks of King County, Snohomish county and Tacoma, and will additionally install a dispatch console in the Port ("the project").  Seattle is the lead agency for the project.
6.  The King County, Seattle, SERS, Tacoma, Port, EPSCA and ValleyCom desire to enter into an interlocal agreement to provide governance over the project and the interoperable connections developed as result of the project.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The executive is hereby authorized to enter into an interlocal cooperation agreement ("the agreement") with the city of Seattle, the Snohomish County Emergency Radio System, the city of Tacoma, the Port of Seattle, the Eastside Public Safety Communications Agency and ValleyCom, in substantially the same form as the attached agreement, providing for replacing three zone controllers and installing one dispatch console, and connecting them together all for the purposes of improving interoperable communications in King, Snohomish and Pierce counties.
      SECTION 2.  The executive is hereby authorized to enter the agreement for a
term of six years and with the option to extend the agreement for one additional period, not to exceed six years.
