Title
AN ORDINANCE establishing February 7, 2006, as the date of a special election on the question of annexation to the city of Issaquah, and assumption of indebtedness, of an unincorporated area known as the Klahanie annexation area and appointing a committee to write the voters' pamphlet statement for the February 7, 2006, special election; and declaring an emergency.

SECTION 1. Findings:
A. The issue of annexation of the Klahanie annexation area to the city of Issaquah has previously been placed before the voters of the area at the general election held November 8, 2005, and in that election, Proposition 1, approving annexation, passed by the requisite margin, however, Proposition 2, approving assumption of outstanding city indebtedness, failed to pass by the requisite margin.
B. The city of Issaquah by Resolution No.2005-11, has determined that it is in the public interest and general welfare to provide for the annexation of an area known as the Klahanie annexation area, in accordance with chapter 35A.14 RCW. The city has indicated that it may request to resubmit both the issues of annexation and assumption of indebtedness to the voters of the area as a combined single ballot proposition.
C. The city of Issaquah, by Resolution No. 2005-4 initiated the annexation of the Klahanie annexation area.
D. The King County boundary review board received a request for review under chapter 36.93 RCW, and on July 14, 2005, the review board, in file 2191, deemed the proposed city of Issaquah Klahanie annexation file approved.
E. The city of Issaquah has indicated to the county that the city council may adopt on the evening of December 5, 2005, an ordinance requesting the King County director of elections to find an emergency and hold a special election on February 7, 2006, and to submit to the qualified electors of the Klahanie PAA a proposition authorizing the Klahanie PAA to be annexed to the city and in the same ballot proposition, a question to authorize an assumption of indebtedness.
F. To meet the statutory deadlines for placing such a proposition on the February 7, 2006 ballot and preserve the city's ability to have such a proposition considered on February 7, 2006, this ordinance is being introduced before formal action by the city council.
G. Pursuant to chapters 29A.04 and 35A.14 RCW, the metropolitan King County council deems an emergency exists for the purpose of calling a special election to be held on the question of this annexation on February 7, 2006.
SECTION 2. A special election shall be held on the 7th day of February 2006 in accordance with chapter 35A.14 RCW within the territory of the proposed annexation, for the purpose of submitting the question of annexation of the Klahanie annexation area and whether or not all property in the annexation area will assume its proportional share of existing city bonded indebtedness.
SECTION 3. The number of registered voters within the subject area is estimated at 5,404 as nearly as may be determined from available records.
SECTION 4. Pursuant to RCW 29A.04.321 and 35A.14.050, it is hereby deemed that an emergency exists for purposes of calling a special election. The King County manager of the records, elections and licensing services division is hereby requested to assume jurisdiction to call and conduct a special election and submit to the registered voters within the subject area of the propositions as set forth in section 4 of this ordinance. The clerk of the council is hereby authorized and directed to transmit the following proposition to the director of the records, elections and licensing services division in substantially the following form, with such additions, deletions or modifications in the ballot title as may be required for the propositions listed below by the King County prosecutor:
PROPOSITION 1: KLAHANIE ANNEXATION AND ASSUMPTION OF INDEBTEDNESS. The Issaquah City Council passed Resolution No. 2005-04 concerning the Klahanie Annexation Area. If approved, this proposition would authorize annexation of that area of unincorporated King County known as the Klahanie Annexation Area as legally described in Resolution No. 2005-04, and would authorize assessment and taxation of property within the Klahanie Annexation Area, if annexed, at the same rate and on the same basis as property within the City of Issaquah is assessed and taxed to pay for the then-outstanding indebtedness of the City of Issaquah. Shall the Klahanie Annexation Area be annexed to the City of Issaquah, and all property within the Klahanie Annexation Area be assessed and taxed at the same rate and on the same basis as the property within the City of Issaquah is assessed and taxed to pay for all or any portion of the then outstanding indebtedness of the City of Issaquah

SECTION 5. The manager of the records, elections and licensing services division is hereby authorized and requested to prepare and distribute a local voters' pamphlet, pursuant to K.C.C. 1.10.010, for the special election called for in this ordinance, the cost of the pamphlet to be included as part of the special election.
SECTION 6. RCW 29A.32.280 provides that for each measure from a jurisdiction that is included in a local voters' pamphlet, the legislative authority of that jurisdiction shall formally appoint a committee to prepare arguments advocating voter approval of the measure and a committee to prepare arguments advocating voter rejection of the measure.
SECTION 7. Pursuant to RCW 29A.32.280, the following individuals are appointed to serve on the voters' pamphlet committees, each committee to write a statement for or against the proposed annexation ballot measure:
