      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      WHEREAS, King County has adopted waste reduction and recycling goals as part of its waste management system and places many responsibilities on cities, as designated in the Comprehensive Solid Waste Management Plan, and;
      WHEREAS, the King County Solid solid Waste waste Division division has provided financial assistance, in the form of grants, since 1989 to help the suburban cities implement recycling collection, yard waste collection and waste reduction and recycling support programs, as authorized by Motions  Numbers 7638, 8407, 8857,,  9847, and 10965 respectively, and:
      WHEREAS, Ordinance No. 14018, which adopted the 2001 Annual Budget for King County, provided for the funding of a waste reduction and recycling grant program to the suburban cities through the end of December 31, 2001, and;
      WHEREAS, the Comprehensive Solid Waste Management Plan, which includes aggressive waste prevention and recycling goals and involves the suburban cities as the King County Solid solid Waste waste Division's division's partners in reaching these goals, and
      WHEREAS, the Comprehensive Solid Waste Management Plan also includes
      WHEREAS, King County's total 2002 budget of $2.9 billion is supported by a variety of revenues, and has adopted waste reduction and recycling goals as part of its waste management system plan and places man responsibilities on suburban cities participating in the solid waste system, as designated in the 1992 Comprehensive Solid Waste Management Plan, and
      WHEREAS, King County has provided financial assistance, in the form of grants since 1989, to help the participating  suburban cities implement recycling collection, yard waste collection, and waste reduction and recycling support programs, as authorized by Mmotion numbers 7638, 8407, and 9847, and 10965 respectivelmost of these revenuesy - $2.4 billion of the $2.9 billion total - are expressly restricted by state law to the purposes for which they are collected, and, and
      WHEREAS, Ordinance No. 14018 adopting the 2000 Annual Budget for King County provides funding for a waste reduction and recycling grant program to assist the participating suburban cities through December 31, 2001the remaining revenues of $500 million, which constitute the county's current expense (CX) fund,, are the only funds available to fund many additional county services, and
      WHEREAS, King County is currently developing the 2001 Comprehensive Solid Waste Management Plan that includes aggressive waste prevention and recycling goals and involves participating suburban cities as the county's partners in reaching these goalsKing County reduced the CX fund budget by $41 million for 2002, and faces continuing current expense fund deficits, on the order of $50fifty million dollars for 2003, with projected additional reductions of $30 million in 2004 and another $30 million in 2005, for a total of $151 million over four years
      WHEREAS, the fiscal shortfall is the result of declining revenue growth and increasing governmental expenses, and
      WHEREAS, the 2001 Comprehensive Solid Waste Management Plan is in draft form and will not be adopted until the third quarter of 2001 at the earliest, after which is
must be ratified by the participating citiesKing County is aggressively reviewing CX expenditures for reductions and has already closed many county parks, and
      WHEREAS, the county , in the interim, would like to continue to support the waste reduction and recycling efforts of participating suburban citiesneeds to be just as aggressive in its review of potential revenue sources, and
      WHEREAS, King County Treasury Operations staff will typically put about one hundred100 tax- forfeited properties up for sale each year, and;
      WHEREAS, in 1997, Hennepin cCounty in Minnesota has implemented a successful tax-forfeited property renovation program that has generated in excess of $1 million in profit, and
      WHEREAS, the Hennepin cCounty program has resulted in more owner occupation of homes than previously experienced, and
      WHEREAS, the Hennepin cCounty program has encouraged the use of local women and minority owned small businesses for renovation work, and
      WHEREAS, the Hennepin cCounty program is currently trialing the use of work crew labor to assist in renovation work, and
      WHEREAS, the council adopted Motion #11491 on July 29, 2002, that in part requested the courts, prosecutor, sheriff and all other agencies involved in the criminal justice system within King County to work together to identify efficiencies and possible reductions, and
      WHEREAS, the Adult Justice Operational Master Plan (AJOMP) has recommended the use of work crews as an alternative to secure detention, and
      WHEREAS, the use of work crews has shown a positive effect on the reduction of recidivism at a reduced cost as compared to secure detention, and
      WHEREAS, in a pilot program, the district court has identified the efficacy of expanding offender work crews as a sanction and a way for offenders to reduce their fines.  Additionally, the court identified that their existing pilot work crews provided needed services to the community that maintain facilities and saved taxpayer dollars, and
      WHEREAS, the district court has identified hundreds of offenders with driving offenses that are currently using valuable court and jail time that would otherwise be eligible for work crew, and
      WHEREAS, if successful, the use of work crew labor in this program could save taxpayer dollars in the criminal justice system and also generate increased revenue for the CX fund from improved tax forfeited property sales;
      NOW, THEREFORE, BE IT MOVED by the Council of King County:
      The executive is requested to establish a tax-forfeited property renovation program and evaluate the possibility of utilizing the work crew program for property clean-up and renovation. Any profit from the implementation of the program shall be allocated as follows:
-      Eighty percent80% cCurrent eExpense (CX) fund; and
-      Twenty percent20% aAffordable housing efforts.
 
A.  The executive is requested to establish and implement a two-year waste reduction and recycling grant program for the years 2002 and 2003 for suburban cities participating in the county's solid waste system.  The grant program shall be implemented according to the provisions in Attachment A to this motion.
      B.        Following county adoption of the 2001 Comprehensive Solid Waste
 
Management Plan, tThe executive is further requested to transmit any required legislation and a program plan as part of the 2003 executive proposed budget.  establishing a three-year waste reduction and recycling grant program for 2004 through 2007.

      NOW, THEREFORE, BE IT MOVED by the Council of King County:
      The King County Solid solid Waste waste Division division is requested to establish a waste reduction
 
and recycling grant program for the suburban cities.  The grant program will be implemented according to the provisions in Attachment A to this motion“Attachments”.

The grant program shall be a continuation of the Solid Waste Division's previous grants-to-cities programs and shall provide for the following:
A.  The distribution of grant funds will begin in 2002 in accordance with the Comprehensive Solid Waste Management Plan and King County Code.
Funding will be approved through the annual budget process and will be consistent with current adopted King County waste reduction and recycling policy and budgets.  At the time any such grant funding is distributed to cities, via the interlocal agreement signature process, the King County Solid Waste Division will assess the waste reduction and recycling grant program and proposed city scopes of work for compliance with current King County waste reduction and recycling policies.
D.  Grant funds will be made available to all suburban cities operating under the Comprehensive King County's Solid Waste Management Plan.  The amount of the grant distributed to each applicant shall include a base amount plus an allocation that shall be calculated according to each applicant's residential and employment population.
E.  Grant-funded programs and/or activities of participating cities will address one or more of the following objectives:
Encourage and promote waste reduction.
Continue to implement and improve general recycling programs.
Improve opportunities for the collection of specific commodities, such as paper.
Improve opportunities for the collection and/or composting of organic materials.
Increase the demand for recycled and reused products.
Foster sustainable development through the promotion of sustainable building principals in construction projects.
Manage solid waste generated by public agencies in a manner that demonstrates leadership.
Product Stewardship.
Broader resource conservation programs that integrate with waste reduction/recycling programs and messages.
At the time any subsequent grant funding is made available to cities, the King County Solid Waste Division will amend these objectives in accordance with current King County waste reduction and recycling policies.
