AN ORDINANCE making a supplemental disappropriation of $11,210,000 to fund 3860, road construction fund, and $0 to fund 1030, road fund, to provide the appropriate level of appropriation authority; amending the 2004 Budget Ordinance, Ordinance 14797, Sections 123, 62 and 63, as amended, and Attachment C, as amended.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Ordinance 14797, Section 123, as amended, is hereby amended by adding thereto and inserting therein the following:
From fund 3860, road construction fund there is hereby appropriated and authorized to be disbursed the following amounts for the specific projects identified in Attachment I to this ordinance.

SECTION 2. Attachment I to this ordinance hereby amends Attachment C to Ordinance 14797, as amended, by adding thereto and inserting therein the projects listed in Attachment I to this ordinance.
SECTION 3. Ordinance 14797, Section 62, as amended, is hereby amended by adding thereto and inserting therein the following:
ROADS - From the road fund there is hereby appropriated to:
Roads $257,000
SECTION 4. Ordinance 14797, Section 63, as amended, is hereby amended by adding thereto and inserting therein the following:
ROADS CONSTRUCTION TRANSFER - From the road fund there is hereby appropriated to:
Roads Construction Transfer ($257,000)
PROVIDED THAT:
Unless funds are reallocated pursuant to K.C.C. 4.04.270, $480,000 of the funds appropriated for CIP Project 201896, 150th Avenue S.E., may only be expended after the council approves by motion a report that includes: a description of the project, life-to-date expenditures, an explanation of the growth in project costs and the causes of delays in implementing the project, and proposals identified by the city of Bellevue and the county to reduce construction costs. The council expects that this report shall be prepared by the city and the county in collaboration.
The report required to be submitted by this proviso must be filed by August 31, 2004, in the form of 16 copies with the clerk of the council, who will retain the original and will forward copies to each councilmember, to the lead staff for the transportation committee or its successor, and to the lead staff of the budget and fiscal management committee or its successor.
PROVIDED FURTHER THAT:
The following projects are eligible to be transferred to a city via interlocal agreement upon annexation of the city's designated potential annexation area or upon incorporation of the area. At the end of three years, the county will reassess whether any unexpended funds should be re-programmed to other road capital projects, with priority given to other projects that would support the goal of accelerated annexations.

EXPENDITURE RESTRICTION:
Of the funds in Attachment I to this ordinance, the 2004 appropriation for the following project may only be expended on that project, unless funds are reallocated pursuant to K.C.C. 4.04.270:
RDCW 17 Agreement with Other Agencies $350,000 may only be spent on C54103 Burke-Gilman/Kenmore.
