AN ORDINANCE approving the Woodinville Water District 2008 Comprehensive Water System Plan.

STATEMENT OF FACTS:
1. King County has adopted K.C.C. chapter 13.24, which requires approval of comprehensive plans for water utilities that distribute or obtain water in unincorporated King County as a prerequisite for operating in unincorporated King County, receiving approval for annexation proposals, being granted right-of-way franchises, and being given approval for right-of-way construction permits. K.C.C. 13.24.060 prescribes the requirements for approval of such plans, including consistency with state and local planning requirements.
2. RCW 57.16.010 requires that general comprehensive plans for water districts be submitted to, and be approved by, the legislative authority within whose boundaries all or a portion of the district lies.
3. Woodinville water district's last water system plan was prepared in 2000. Both Washington state Department of Health ("DOH") and King County regulations require water system plans to be updated every six years.
4. The Woodinville water district ("the district") is in King County and has adopted a 2008 comprehensive water system plan ("the plan").
5. King County has adopted a comprehensive plan that includes water supply policies in its provisions for facilities and services (policies F-201 through F-244) that call for consistency with other adopted plans, support for regional water supply planning, pursuit of reclaimed water, water conservation and protection of water resources.
6. K.C.C. chapter 13.24 requires the utilities technical review committee ("UTRC") to review and make a recommendation to the King County executive and council on the plan and the requirements under K.C.C. chapter 13.24 and consistency with the King County Comprehensive Plan. The UTRC has reviewed the planning data and district operations and found:
a. The district is in compliance with its comprehensive plan, including water conservation elements, and can meet its duty to provide timely and reasonable service within its service area as required under chapters 43.20 and 70.116 RCW;
b. The infrastructure system for the existing service area and for the area anticipated to be served in the future is based on the adopted land use map of the Comprehensive Plan. The population and employment forecasts developed for the service area are appropriately used;
c. The plan has information sufficient to demonstrate the ability to provide service consistent with the requirements of all applicable statutes, codes, rules and regulations;
d. The plan is consistent with the DOH planning requirements under chapter 246-290 WAC and includes an evaluation of reclaimed water opportunities, as required by RCW 90.46.120;
e. The plan is consistent with K.C.C. chapter 17.08 relating to the installation of fire hydrants and water mains;
f. The plan is consistent with state and local health standards;
g. The plan supports the creation and maintenance of logical service areas consistent with the East King County Coordinated Water System Plan approved under chapters 43.20 and 70.116 RCW and the duty to serve under RCW 43.20.260;
h. The plan is consistent with service area boundary requirements as identified in RCW 90.03.386;
i. The district works with the cities and other special purpose districts to ensure the elimination or prevention of duplicate facilities;
j. The district provides service at a reasonable cost, maximizes the use of the existing public facilities, and participates in the implementation of the East King County Coordinated Water System Plan, all of which promotes the most reliable and healthful service to the public;
k. The plan is consistent with the King County Comprehensive Plan and other pertinent county adopted plans and policies;
l. The district meets applicable state water quality and water conservation standards; and
m. The plan is consistent with the Growth Management Act and district water used was diverted consistent with a habitat conservation program for the source.
7. The DOH approval of the district's plan is pending King County council action.
8. The district completed a state Environmental Policy Act checklist and issued a determination of nonsignificance for the issuance of the plan on October 8, 2008. There was no appeal.
9. The district's operations and facilities meet multiple existing statutory, administrative and planning standards. As the district's operations, facilities and planning meet the requirements of the King County Code, and are consistent with the King County Comprehensive Plan, the UTRC recommends approval of the plan.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The Woodinville Water District 2008 Comprehensive Water
System Plan, Attachment A to this ordinance, is hereby approved as a comprehensive water system plan.
