AN ORDINANCE relating to the King County Norm Maleng Regional Justice Center hot water piping system replacement project; making a disappropriation and reappropriation of $3,056,114, to the major maintenance reserve fund; and amending the 2009 Budget Ordinance, Ordinance 16312, Section 129, as amended, and Attachment F, as amended.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Ordinance 16312, Section 129, as amended, is hereby amended by adding thereto and inserting therein the following:
From several capital improvement project funds there is hereby disappropriated and appropriated and authorized to be disbursed the following amounts for the specific projects identified in Attachment A to this ordinance.

ER1 Expenditure Restriction:
Of this appropriation, $50,000 shall not be expended or encumbered until the executive submits and the council by motion approves a report, on a recommendation for a targeted maximum annual CIP carryover amount for the major maintenance reserve fund. The report shall include a comparison showing how the recommendation comports with the carryover percentages for the other flexible budgeting programs in King County and shall include a plan and timeline for implementation.
The report must be filed in the form of 11 copies with the clerk of the council, who shall retain the original and will forward copies to each councilmember and to the lead staff for the capital budget committee, or its successor.
P1 PROVIDED THAT:
Of the appropriation for CIP Project number 344004, RJC Hot Water Piping, $100,000 shall be not be expended or encumbered until the final monthly report for the project is received by the council. Monthly reports shall include: the progress of design and construction; itemized expenditures to date for construction, security escorts, contingency and county administration; status of the investigation into the cause of the problem; progress of work within the building; a risk assessment for building occupants; as well as any unanticipated problems associated with the deterioration of the hot water pipes. The reports shall be due the last day of each month, shall commence on March 31, 2009, and shall continue each month until all construction work within the building is completed.
Eleven copies of the reports must be filed monthly with the clerk of the council, who shall retain the original and will forward copies to each councilmember and to the committee coordinator of the budget and fiscal management committee, or its successor.
P2 PROVIDED FURTHER THAT:
Of the appropriation for CIP Project number 344004, RJC Hot Water Piping, $2,000,000 shall be not be expended or encumbered until the council has approved by motion a waiver of competitive bidding and solicitation requirements.
SECTION 2. Attachment A to this ordinance hereby amends Attachment F to
Ordinance 16312, as amended, by adding thereto and inserting therein the projects listed in Attachment A to this ordinance.
