AN ORDINANCE amending the Comprehensive Water Pollution Abatement Plan, a King County functional plan.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1.  Findings:
      The metropolitan King County council makes the following legislative findings regarding the inclusion of the city of Carnation in its wastewater service area:
      A.  King County owns and operates a regional wastewater conveyance and treatment system for the purpose of providing wastewater treatment and disposal service to local governments in its service area.  That service is provided in accordance with long term agreements that obligate the county to accept the sewage delivered to its facilities by the local governments with which it has the agreements and obligates the local governments to deliver the sewage they collect to the county's wastewater facilities;
      B.  The metropolitan King County council, in assuming the legislative powers of the municipality of metropolitan Seattle, readopted the Comprehensive Water Pollution Abatement Plan by Ordinance 12074 on December 6, 1995.  The plan was amended and readopted by Ordinance 13680 on November 29, 1999, to incorporate the Regional Wastewater Services Plan;
      C.  The city of Carnation now desires to become part of the King County wastewater treatment system service area to facilitate development of wastewater treatment facilities to serve the city of Carnation.  On July 2, 2002, the Carnation city council approved an agreement for sewage disposal with King County.  Under the terms of that agreement, King County would develop, own and operate facilities necessary to provide sewage treatment service to the city; and
      D.  Adding the city of Carnation to the King County metropolitan wastewater area requires amendment of King County's Comprehensive Water Pollution Abatement Plan.  To comply with the state Environmental Policy Act, chapter 43.21C RCW, and chapter 197-11 WAC, King County will be required to conduct an environmental review process on this plan amendment concurrent with project predesign.
      SECTION 2.  Plan amended.  Under the King County charter and RCW 35.58.200, the Comprehensive Water Pollution Abatement Plan for King County is hereby amended to include the sewer service area for the city of Carnation. The sewer service area for the city of Carnation, as construed for purposes of this ordinance, is the area contained within the Carnation city limits and the adjacent area within King County's designated Urban Growth Area, as now or in the future constituted.  This plan amendment includes such wastewater conveyance and treatment facilities as King County may deem necessary for providing wastewater treatment service to the city of Carnation.
      SECTION 3.  Severability.  If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance or the application of the provision to other persons or circumstances is not affected.
