AN ORDINANCE authorizing the executive to enter into interlocal agreements with the city of Issaquah relating to the transition of local government services in the urban unincorporated communities of Klahanie and Greenwood Point/South Cove and the transfer of surface water drainage facilities and park properties.

STATEMENT OF FACTS:
1. King County's Annexation Initiative encourages the expedited annexation of all remaining urban unincorporated areas in order to achieve both financial stability in the current expense fund, and the regional land use vision set forth in the countywide planning policies.
2. The community of Klahanie is one of the ten large urban unincorporated areas remaining in the county and under the Annexation Initiative is designated as a priority area for transfer.
3. On November 8, 2005, the residents of Klahanie and Greenwood/South Cove ("annexation areas") will have the opportunity to vote for annexation to the city of Issaquah.
4. In the interest of ensuring a smooth transition of services to residents of the annexation areas, the city of Issaquah and King County wish to enter into an interlocal agreement which addresses transfer of public records, transfer of ownership of surface water management facilities and parks properties and other matters.
5. The agreement includes the transfer of Annexation Initiative incentive funds, and therefore was constructed in concert with the terms, conditions and policy intent of Motion 12018, the Annexation Initiative motion.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The county executive is hereby authorized to enter into an interlocal agreement, substantially in the form of Attachment A to this ordinance, with the city of Issaquah to provide for the orderly transition of governmental services and property in the event of annexation, including but not limited to the transfer of $1.1 million in road fund revenues and $850,000 in annexation incentive funding and to transfer the surface water drainage facilities and park properties as referenced therein. The executive is further authorized to enter into an interlocal agreement or agreements with Issaquah for the transfer of park properties substantially in the form of the Form of Intergovernmental Transfer Agreement for Local Parks and Open Space Properties that is included as Exhibit B to Attachment A to this ordinance, with such modifications as are necessary to reflect the specific characteristics of each park or open space property, including without limitation, characteristics related to funding sources, title matters, encumbrances, reserved easements and the current use and development of the properties.
