Title
AN ORDINANCE authorizing the King County executive to execute a contract for phase II site facilities construction of the new Bow Lake recycling and transfer station.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. Ordinance 16247, approved October 3, 2008, directed the King County executive, through the solid waste division of the department of natural resources and parks (“the division”) to procure a contractor for construction of site facilities for the new Bow Lake recycling and transfer station using the competitive negotiation process in RCW 36.58.090.
B. Ordinance 16247 included draft evaluation criteria for the review of competitive proposals in accordance with RCW 36.58.090 and established a procedure to develop and use final evaluation criteria. Proposed final criteria were transmitted to the King County council for review and comment on December 16, 2009. No objections to the proposed final criteria were received and the criteria took effect twenty-one days after transmittal.
C. A request for proposals was issued on January 22, 2010, to the three highest-ranked applicants selected through evaluation of statements of qualification previously submitted. All three submitted technical proposals on April 23, 2010, and sealed price proposals on April 30, 2010. The evaluation criteria were used to evaluate the technical proposals and Lydig Construction, Inc., received the highest score and has been initially determined to be the best qualified.
D. Funding for the project has previously been appropriated.
E. Documents, including the request for proposals, provided by the division to contractors, anticipated an October 2010 start date, and contractors based key personnel availability, small contractor participation, and project costs on being able to begin construction in the fall of 2010.
F. The Solid Waste Transfer and Waste Management Plan, adopted by Ordinance 15979, was developed cooperatively with solid waste stakeholders and contains recommendations and a schedule for implementing recommendations including the replacement of the Bow Lake Transfer Station.
G. The site is on a steep slope, is the site of a former landfill and has been disturbed by phase I site preparation work. Execution of the contract will allow the contractor to install improvements necessary to manage on-site surface water before the winter rains to ensure the protection of public health and safety and to help prevent erosion that could degrade water quality and impact downstream property owners.
H. In order to stay within the project budget, optimize environmental protection, ensure public health and safety and allow construction to begin in the fall of 2010, the executive needs authorization to execute a contract before September 27, 2010.
SECTION 2. Having held a public hearing, the King County council determines that it is in the public interest to enter into the contract substantially in the form of Attachment A to this ordinance for the site facilities construction phase of the new Bow Lake recycling and transfer station, that the contract is financially sound, and that it is advantageous for the county to use this method for awarding contracts compared to other methods.
SECTION 3. The executive is hereby authorized to execute a contract with Lydig Construction, Inc., for the site facilities construction phase of the new Bow Lake recycling and transfer station substantially in the form of Attachment A to this ordinance.
