Title

AN ORDINANCE authorizing the condemnation of property interests needed for the Fifteen Mile Creek Bridge No.493C replacement project located in unincorporated King County along SE May Valley Road 0.2 miles west of Issaquah-Hobart Road SE in council district nine.

Body

                     SECTION 1Findings:

                     A.  King County's Fifteen Mile Creek Bridge No.493C project will replace the existing King County timber bridge originally built in 1932 that is now past its useful life.  The existing timber bridge is located on Southeast May Valley Road that connects the cities of Issaquah, Renton, and Maple Valley and unincorporated King County.  The property rights that are the subject of this ordinance must be acquired for the Fifteen Mile Creek Bridge No.493C project.  The county and the property owner were unable to agree on a voluntary transfer of the property rights.

                     B.  The new bridge will be designed and constructed to meet current national bridge standards that include weight capacity, lane and shoulder widths, and environmental protection.  Those standards improve safety by adding standard eight-foot shoulders for people walking, biking, and rolling and benefit the environment by replacing the existing wooden bridge support piles that are treated with creosote, which can be harmful to fish and the environment and replaces them with an out-of-water steel and concrete support system.

                     C.  King County is authorized, by chapter 8.12 RCW, chapter 36.56 RCW, chapter 35.58.200 RCW, and chapter 35.58.320 RCW, to acquire, damage, and condemn certain properties, property rights, and rights in property for the public use for road facilities.

                     D.  To carry out the Fifteen Mile Creek Bridge No.493C project, it is necessary for King County to condemn and damage certain lands, property rights, and rights in property.

                     E.  King County council finds that public health, safety, necessity, convenience, and welfare require that the Fifteen Mile Creek Bridge No.493C project be constructed and that certain properties, property rights, and rights in property be condemned, appropriated, taken, and damaged for the purpose of construction, operation, and maintenance of the Fifteen Mile Creek Bridge No.493C project.

                     SECTION 2.  The King County council deems it necessary for the proposed public purpose and in the best interest of the citizens of King County that all or any portion of the property identified by tax parcel 509030-0015 or other property interests, property rights, or rights in properties be condemned, appropriated, taken, or damaged or any combination thereof, for the purpose of constructing, installing, operating, maintaining, repairing, and replacing facilities for the Fifteen Mile Creek Bridge No.493C project, subject to the making or paying of just compensation to the owners therein in the manner provided by law.

                     SECTION 3.  Condemnation proceedings are hereby authorized to acquire property interests, property rights, and rights in property in all or any portion of the properties identified by tax parcel number 509030-0015.

                     SECTION 4.  The attorneys for King County are hereby authorized and directed to begin to prosecute the proceedings provided by law to condemn, take, damage, and appropriate the land and other property interests, property rights, and rights in property necessary to carry out this ordinance.

                     SECTION 5.  If any provision of this ordinance or its application to any person or

circumstance is held invalid, the remainder of the ordinance or the application of the provision to other persons or circumstances is not affected.
