AN ORDINANCE approving the Coal Creek Utility District 2002 Interim Comprehensive Sewer System Plan.

PREAMBLE:
K.C.C. chapter 13.24 requires approval of comprehensive plans for sewer utilities as a prerequisite for granting right-of-way franchises and approval of right-of-way construction permits.
The Coal Creek Utility District 2002 Interim Comprehensive Sewer System Plan ("plan") discusses sewer service to existing and future populations within the district's six-and-one-half-square-mile service area. The service area includes parts of the cities of Bellevue, Newcastle and Renton, and approximately one hundred seventy-five acres of urban unincorporated King County. Currently, approximately sixteen thousand people are served by the district. At buildout, the population projected to reside in the service area will be over twenty-one thousand.
In August 2001 the district and the city of Bellevue entered into a settlement agreement regarding the city's assumption of parts of the district lying within the city's corporate boundary. Effective December 31, 2003, the city will assume ownership of the district's facilities located within city boundaries. This plan discusses the future assumption and its impacts on the district based on information currently available.
All of the district's wastewater flows are treated by King County. The average daily sanitary flow currently treated by the county is approximately six million gallons per day. At buildout of the service area, that amount is expected to increase to about seven million gallons per day, although reductions in base water use will likely decrease the ultimate flow significantly. Recent monitoring shows that the district currently has rates of infiltration and inflow in excess of those allowed by the county. The district is working with the county to reduce infiltration and inflow into its sewer system.
A six-year capital improvement program was identified at a cost of approximately three million two hundred thousand dollars. The planned improvements include lift station construction and upgrades, replacement of old sewer mains and extension of sewers to unsewered areas. Funding for the capital improvements will come from general facilities charges, local improvement districts, low-interest loans and developer funding for currently unsewered areas. Funding strategies and proposed improvements to reduce infiltration and inflow in the region are currently being developed by the county and sewer utilities.
The King County utilities technical review committee ("UTRC") reviewed the plan on May 8, 2002 and recommended several technical changes that have been incorporated into the final plan version attached to this ordinance. The UTRC recommends that the council approve the plan.
The district prepared a determination of non-significance for the plan on May 26, 1999, in accordance with the state Environmental Policy Act. The district intends to adopt the plan after receiving state and county approval.
K.C.C. 13.24.010 states that King County may require an updated plan, plan amendment, or other documentation whenever conditions for water or sewer availability have changed significantly within a water or sewer utility service area.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The Coal Creek Utility District 2002 Interim Comprehensive Sewer System Plan, Attachment A to this ordinance, is hereby approved. The Coal Creek utility district shall submit for county approval an update or amendment to its comprehensive sewer system plan describing the effects of the partial assumption on service area, sewage flows, the capital improvement program and finances and rates, within one year of the
completion of the assumption. The Coal Creek utility district is required to prepare a new sewer comprehensive plan for approval by King County within six years.
