STATEMENT OF FACTS:
1.  King County has adopted K.C.C. chapter 13.24, which requires approval of comprehensive plans for sewer utilities that obtain wastewater in unincorporated King County as a prerequisite for:  operating in unincorporated King County; receiving approval for annexation proposals; being granted right-of-way franchises; and being given approval for right-of-way construction permits.  K.C.C. 13.24.060 prescribes the requirements for approval of such plans, including consistency with state and local planning requirements.  Approval of the plan is also required under K.C.C. chapter 28.84 if the utility is a component agency of the regional system.
2.  RCW 57.16. 010 requires that general comprehensive plans for wastewater districts be submitted to, and approved by, the legislative authority within whose boundaries all or a portion of the district lies.
3.  The Valley View sewer district ("the district") most recently prepared a comprehensive sewer plan in 2000.  Both Washington state Department of Ecology and King County regulations require wastewater plans to be updated every six years.
4.  The district is in King County and has adopted the 2011 Comprehensive Sewer System Plan ("the plan").
5.  King County has adopted a Comprehensive Plan that includes wastewater policies in its provisions for facilities and services (policies F-245 through F-254) that call for consistency with other adopted plans and that support regional waste planning, pursuit of reclaimed water, water conservation and protection of water resources.
6.  K.C.C. chapter 13.24 requires that the utilities technical review committee ("UTRC") review and make a recommendation to the King County executive and council on the plan and its consistency with the requirements under K.C.C. chapter 13.24 and the King County Comprehensive Plan.  The UTRC has reviewed the planning data and district operations and hereby finds:
 a.  The plan uses population and employment forecasts adopted by the cities and County for the district's service area;
 b.  Existing and planned wastewater flows for average and peak flow are reasonable;
  c.  The capital facility plan is adequate to meet anticipated facility and service needs;
 d.  There are no areas of concern with respect to corrosion and odor control;
  e.  The amounts of inflow and infiltration are reasonable and steps are being taken to reduce inflow and infiltration;
 f.  The plan is consistent with applicable Washington state water quality laws, including the evaluation of reclaimed water use; and
 g.  The plan is consistent with other pertinent county adopted plans and policies.
7.  Washington state Department of Ecology's approval of the district's plan is pending King County council action.
8.  Under the state Environmental Policy Act the district issued a determination of nonsignificance for the issuance of the plan on January 24, 2012, and there were no appeals.
9.  The district's operations and facilities meet multiple existing statutory, administrative and planning standards.  As the district's operations, facilities and planning meet the requirements of the K.C.C., and are consistent with the King County Comprehensive Plan, the UTRC recommends approval of the plan.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  The Valley View Sewer District 2011 Comprehensive Sewer System Plan, Attachment A to this ordinance, is hereby approved as a general sewer plan.
