Title
AN ORDINANCE establishing November 2, 2004, as the date of a special election on the question of annexation of approximately one thousand two hundred eighty-five acres in the city of Normandy Park into the Southwest Suburban sewer district for the purpose of providing sewer service and appointing a committee to write the voters pamphlet statement for the November 2, 2004, special election.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      A.  A notice of intention proposing the annexation of approximately one thousand two hundred eighty-five acres of land into the Southwest Suburban sewer district ("district") for the purpose of providing sanitary sewer service was filed with the county council on March 10, 2004.
      B.  Voters constituting not less than ten percent of the registered voters in the proposed annexation area who voted in the last municipal general election petitioned the district to annex the area and make it a part of the district.
      C.  On October 13, 2003, the King County records, elections, and licensing services division found the petition sufficient.  The district concurred with the proposed transfer in Resolution No. 2004-11, passed on March 2, 2004.  Copies of the certified petition and the resolution were filed with the county council.
      D.  The district filed a determination of nonsignificance on the proposed annexation dated February 10, 2004.
      E.  The King County boundary review board completed its evaluation of the proposed annexation under chapter 36.93 RCW and deemed the annexation of approximately one thousand two hundred eighty-five acres of land into the Southwest Suburban sewer district approved effective April 23, 2004.
      F.  On April 26, 2004, the metropolitan King County council approved the proposed annexation but noted that its approval does not constitute county approval or disapproval of any other permits, certifications or actions necessary to provide service to this annexation area.  One of the actions necessary to provide service is approval of the annexation at a special election by qualified voters as specified in RCW 57.24.040.
      G.  Pursuant to chapters 29.13 and 57.24 RCW, the county council deems an emergency to exist for the purpose of calling a special election to be held on the question of this annexation on November 2, 2004.
      H.  K.C.C. chapter 1.10 provides for the publication and distribution of local voters pamphlets in conformity with the provisions of chapter 29A.32 RCW for elections held in King County.
      I.  RCW 29A.32.280 provides that for each measure from a jurisdiction that is included in a local voters pamphlet, the legislative authority of that jurisdiction shall formally appoint a committee to prepare arguments advocating voter approval of the measure and a committee to prepare arguments advocating voter rejection of the measure.
      SECTION 2.  A special election shall be held on November 2, 2004, in accordance with chapter 57.24 RCW within the territory of the proposed annexation, for the purpose of submitting the question of annexation of the Normandy Park property annexation area.  The expense of the special election shall be paid for out of the funds of the district as specified in RCW 57.24.050.
      SECTION 3.  The number of registered voters within the subject area is estimated at 3,304 as nearly as may be determined from available records.
      SECTION 4.  It is hereby found that an emergency exists for the consideration by the electors of the proposed annexation.  Pursuant to RCW 29A.04.321 and 57.24.020, it is hereby deemed that an emergency exists.  The King County directorvof the records, elections and licensing services division is hereby requested to assume jurisdiction to call and conduct a special election and submit to the registered voters within the subject area the proposition as set forth in section 4 of this ordinance.  The clerk of the council is hereby authorized and directed to transmit this proposition to the director of records, elections, and licensing services division, with such additions, deletions or modifications in the ballot title as may be required for the propositions listed below by the King County prosecutor:
      PROPOSITION 1:  Shall the area of the city of Normandy Park, which is legally described in King County Ordinance14883, be annexed to and become part of the Southwest Suburban Sewer District?

      SECTION 5.  The boundaries of the territory proposed for annexation are hereby described in Attachment A to this ordinance.
      SECTION 6.  The director of the records, elections and licensing services division is hereby authorized and requested to prepare and distribute a local voters pamphlet, pursuant to K.C.C. 1.10.010, for the special election called for in this ordinance, the cost of the pamphlet to be included as part of the cost of the special election.
      SECTION 7.  That pursuant to RCW 29A.32.280, the following individuals are appointed to serve on the voters pamphlet committees, each committee to write a
 
statement for or against the proposed levy:
