BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
NEW SECTION. SECTION 1. There is hereby added to K.C.C. chapter 4A.700 a new section to read as follows:
A.1. The following administrative security fees described in K.C.C. 15.96.010 for issuing, renewing, and reprinting airport security badges, issuing security keys, processing fingerprints, and establishing mobile credentialing shall apply:

2. The security fee categories and rates are subject to, and defined by, the following:
a. Security fees shall be imposed on the sponsoring company. If there is not a sponsoring company, then the security fee shall be imposed on the individual seeking the security device or service;
b. The renewal badge processing fee shall be imposed when a security badge is renewed. F.A.A. guidelines shall dictate when a security badge shall be renewed; and
c. The badge reprinting fee shall apply to badges reprinted outside the badge renewal process for circumstances, including but not limited to, an individual or company name change, a damaged badge, or a new photo request.
B.1. The following administrative security device replacement fees described in K.C.C. 15.96.010 for replacing lost or stolen security badges and security keys shall apply:

2. The security device replacement fee categories and rates are subject to, and defined by, the following:
a. Security device replacement fees shall be imposed on the sponsoring company. If there is not a sponsoring company, then the security device replacement fee shall be imposed on the individual seeking to replace the security device. The security device replacement fee shall be paid prior to issuing the replacement security device; and
b. The security device replacement period shall reset on the date that the security badge or security key is renewed.
C.1. The following administrative unreturned security device fees described in K.C.C. 15.96.010 for failing to return security badges and security keys shall apply:

2. The unreturned security device fee categories and rates are subject to, and defined by, the following: unreturned security device fees shall be imposed on the airport tenant or contractor who failed to return the security device.

2. The administrative airport permit fee categories and rates are subject to, and defined by, the following:
a. Airport permit fees shall be imposed on the individual or company seeking the airport permit; and
b. Airport permits shall be renewed one year from the date of issuance.
SECTION 2. Ordinance 17919, Section 3, as amended, and K.C.C. 4A.700.850 are hereby amended to read as follows:
Except as otherwise provided under K.C.C. 15.52.060, the following aircraft parking rates shall apply:

SECTION 3. Ordinance 17919, Section 6, and K.C.C. 4A.700.860 are hereby amended to read as follows:
A.1. The fuel ((field use)) flowage fee ((charge)) prescribed in K.C.C. 15.56.010 shall be ((eight cents for JetA type fuel and five and one-half cents per gallon for AvGas type fuel)) as follows:

2. The fuel flowage fee categories and rates are subject to, and defined by, the following:
a. Jet A is a kerosene-based aviation fuel derived from crude oil;
b. Jet A Sustainable Aviation Fuel is an alternative aviation fuel made from non-petroleum feedstocks that reduces emissions from air transportation. To qualify for the Jet A Sustainable Aviation Fuel fuel flowage fee, the blend ratio between Jet A and Jet A Sustainable Aviation Fuel shall be greater than twenty-five percent Jet A Sustainable Aviation Fuel on delivery;
c. Avgas 100LL is a low-lead aviation fuel with an octane rating of one hundred; and
d. Unleaded Avgas is an aviation fuel without lead additives.
B. Airport late fees and penalties shall be assessed under K.C.C. 15.56.010 shall be in the amount of one and one-half percent per month for unpaid rates, charges, or fees.
SECTION 4. Ordinance 17919, Section 8, and K.C.C. 4A.700.870 are hereby amended to read as follows:
The landing fee under K.C.C. 15.64.020 is ((one)) three dollars ((and fifty cents)) per thousand pounds of the aircraft's certificated maximum gross landing weight as published in the manufacturer's aircraft operating manual, computed to the nearest five cents, with a minimum of five dollars per landing ((plus outside storage charge on all aircraft parked on county property)).
NEW SECTION. SECTION 5. There is hereby added to K.C.C. chapter 15.08 a new section to read as follows:
"Based aircraft" means aircraft that are operational and airworthy that are hangered or tied down at the airport for more than six months per calendar year.
SECTION 6. Ordinance 1159, Article XIII, Section 1, and K.C.C. 15.52.010 are hereby amended to read as follows:
Rentals, rates, charges, and conditions for use of the airport and its public facilities shall be those specified in this chapter and may be amended from time to time by the King County council.
SECTION 7. Ordinance 1159, Article XIII, Section 2, and K.C.C. 15.52.020 are hereby amended to read as follows:
A complete copy of all ((existing,)) current rates, fees, and charges applicable to ((B.F.I.)) the airport is available ((upon request from the office of the airport manager)) on the airport’s website.
NEW SECTION. SECTION 8. There is hereby added to K.C.C. chapter 15.52 a new section to read as follows:
Administrative fees shall be imposed for issuing and annually renewing airport permits as specified in section one of this ordinance. Payment of airport permit fees is due within thirty calendar days of the invoice date. Airport late fees and penalties shall be assessed in the amount of one and one-half percent per month for unpaid rates, charges, or fees. Failure to pay airport rates, charges, and fees may, at the sole discretion of the airport manager, result in a loss of use of airport facilities and legal action to recover unpaid rates, charges, or fees.
SECTION 9. Ordinance 10500, Section 1, as amended, and K.C.C. 15.52.060 are hereby amended to read as follows:
Charges shall be made for ((storage of)) parking aircraft on ((county property, except that short-term, transient aircraft parking provided adjacent to the terminal building for aircraft weighing zero to twelve thousand five hundred pounds shall be free for the first hour)) airport-operated ramps as specified in K.C.C. 4A.700.850. Before arrival, ((T))the pilot shall notify the airport operations office ((upon arrival)) to arrange parking. ((All other aircraft parking shall have the rates specified in K.C.C. 4A.700.850.))
SECTION 10. Ordinance 17919, Section 4, and K.C.C. 15.52.065 are hereby amended to read as follows:
All airport facilities used by the general public, tenants, and public and private organizations, including governmental units and agencies, may be assessed a market rental rate or charge for the use of facilities. For the purpose of this section, "facilities" include, but are not limited to, rooms, public areas, parking lots, aircraft ramps, and terminal building, as well as water, storm water, or other utility systems.
SECTION 11. Ordinance 1159, Article XIII, Section 9, as amended, and K.C.C. 15.52.090 are hereby amended to read as follows:
Payment of ((monthly)) parking fees specified in K.C.C. 4A.700.850 and 15.52.060 is due ((and payable in advance on the first day of each calendar month. Payment of daily parking fees shall be made prior to departure of aircraft, unless arrangements have been approved by the airport manager)) within thirty calendar days of the invoice date. Airport late fees and penalties shall be assessed in the amount of one and one-half percent per month for unpaid rates, charges, or fees. Failure to pay airport rates, charges, and fees ((or rents)) may, at the sole discretion of the airport manager, result in a loss of use of airport facilities and legal action to recover unpaid rates, charges, or fees.
SECTION 12. Ordinance 1159, Article XIV, Section 1, as amended and K.C.C. 15.56.010 are hereby amended to read as follows:
Oil companies or fuel distributor companies, or both, engaged in the business of selling or delivering aviation fuel to any individual, business firm, United States government, or organization on ((B.F.I.)) the airport, or selling aviation fuel to any individual, business firm, United States government, or organization to be used in aircraft located on or being serviced to take off from ((B.F.I.)) the airport, shall pay a fuel ((field use)) flowage fee ((charge)) in an amount specified in K.C.C. 4A.700.860.A. ((This charge)) The fee shall be collected by the oil companies or fuel distributor companies, or both, making the sale or delivery and reported in a form prescribed by and acceptable to the airport manager with remittance made to the airport on or before the twentieth of each month. Airport late fees and penalties shall be assessed in the amount specified in K.C.C. 4A.700.860.B. Failure to pay airport rates, charges, and fees ((or rents)) may, at the sole discretion of the airport manager, result in a loss of use of airport facilities and legal action to recover unpaid rates, charges, or fees.
SECTION 13. Ordinance 1159, Article XV, Section 1, as amended, and K.C.C. 15.60.010 are hereby amended to read as follows:
No person shall allow any aircraft owned by the person or under the person's control to land, take off, use ((B.F.I.)) airport facilities ((or)), be parked, or be tied down on ((B.F.I.)) the airport without causing all applicable landing, tie-down, or other fees respecting such aircraft or use of ((B.F.I.)) airport facilities to be paid. Any such fees that become due and owing shall constitute a lien on such aircraft. Airport late fees and penalties shall be assessed in the amount of one and one-half percent per month for unpaid rates, charges, or fees. Failure to pay airport rates, charges, and fees ((or rents)) may, at the sole discretion of the airport manager, result in ((either)) a loss of use of airport facilities ((or)) and legal action to recover unpaid rates, charges, or fees ((, or both the loss of use and legal action)).
SECTION 14. Ordinance 1159, Article XVI, Section 2, as amended, and K.C.C. 15.64.020 are hereby amended to read as follows:
Aircraft operating in accordance with this chapter are subject to a landing fee in an amount specified in K.C.C. 4A.700.870. Failure to pay airport rates, charges, and fees ((or rents)) may, at the sole discretion of the airport manager, result in a loss of use of airport facilities and legal action to recover unpaid rates, charges, or fees. ((Airport late fees and penalties shall be assessed in the amount of one and one-half percent per month for unpaid rates, charges or fees. Failure to pay airport rates, charges and fees or rents shall result in a loss of use of airport facilities.))
SECTION 15. Ordinance 1159, Article XVI, Section 3, and K.C.C. 15.64.030 are hereby repealed.
SECTION 16. Ordinance 1159, Article XVI, Section 4, and K.C.C. 15.64.040 are hereby amended to read as follows:
Payment of charges pursuant to this chapter shall be made ((prior to the departure of aircraft, unless arrangements have been approved by the airport manager)) within thirty calendar days of the invoice date.
SECTION 17. Ordinance 3382, Section 21, as amended, and K.C.C. 15.64.060 are hereby amended to read as follows:
((A passenger terminal user fee in the amount of one dollar per deplaning
passenger shall be charged to the owner or operator of aircraft with a passenger seating capacity of ten or greater operating pursuant to this chapter. This fee shall apply to passenger deplanement made through or into the passenger terminal building or buildings on B.F.I.)) The King County council reserves the right to charge a passenger facility charge in accordance with the current F.A.A. regulations.
SECTION 18. Ordinance 3382, Section 22, as amended, and K.C.C. 15.64.070 are hereby amended to read as follows:
A. Aircraft, based or not based at the airport, ((and operated for hire or compensation or engaged in commercial business activity, regardless of weight,)) shall pay a landing fee based on the aircraft certificated maximum gross landing weight as published in the manufacturer's aircraft operating manual.
B. The following exemptions to the landing fee apply:
1. General aviation aircraft ((based at the airport, regardless of weight and with a King County airport lease, agreement or permit are exempt from the landing fee)) with a maximum gross landing weight under eight thousand pounds as published in the manufacturer’s aircraft operating manual;
2. ((General aviation aircraft that are not airport based but are using the airport, and that are twelve thousand five hundred pounds and under as published in the manufacturer's aircraft operating manual and are not for hire or provided compensation or engaged in commercial business activity, such as scheduled and other certificated air carriers, aircraft charters, air-taxi, air cargo, air courier, air travel clubs and air ambulance are exempt from the landing fee)) Aircraft based at the airport that are owned or operated by a tenant in a lease with King County and that are not operated for hire or compensation, or engaged in business or commerce;
3. ((Aircraft based at the airport and operated by flight schools or operated for the purpose of flight instruction and performing "touch and go landings" by which an aircraft lands and departs on a runway without stopping or exiting the runway shall be charged a landing fee only if the aircraft exits the runway;
4.)) Humanitarian flights, also known as angel flights, which are operated as not-for-profit or nonrevenue generating flights for humanitarian, medical, or disaster relief purposes are exempt from the landing fee; ((and)) or
((5.)) 4. Any aircraft exempt under state or federal statute or regulatory code is exempt from the landing fee.
SECTION 19. Ordinance 16217, Section 68, and K.C.C. 15.96.010 are hereby amended to read as follows:
The airport shall maintain a security program in compliance with F.A.A. and Transportation Security Administration guidance. The airport shall maintain an access control system for airfield and building security. The airfield and building access control system shall include a security badge and security key system, fingerprint processing, and mobile credentialing for employees, tenants, tenant employees, vendors, suppliers, and contractors ((and guests)). Airport employees, tenants, and other personnel are required to obtain and display an airport issued photo identification badge while at the airport and in airport regulated buildings. All security badges and security keys are the property of the airport and shall be returned to the airport operations and compliance office upon termination of leases, employment, or other activity. The airport ((may)) shall impose an administrative fee as ((part of the annual county budget process for issuing airport badges. The airport shall impose an administrative fee of twenty-five dollars for replacement of lost, stolen or nonreturned security badges)) specified in section 1 of this ordinance for issuing, renewing, reprinting, replacing, and failing to return airport
security badges and security keys, for processing fingerprints, and issuing mobile credentialing.
