AN ORDINANCE revising the corporate boundary of the city of Tukwila to include a half street right-of-way of 53rd Avenue South as provided for in RCW 35.21.790.

STATEMENT OF FACTS:
1. The city of Tukwila's corporate boundary currently extends along the centerline of the right-of-way for 53rd Avenue South between South 170th Street and South 172nd Lane.
2. The city of Tukwila's corporate boundary currently includes the easterly half of the right-of-way for 53rd Avenue South between South 170th Street and South 172nd Lane within Tukwila's current city limits.
3. The westerly half of the right-of-way for 53rd Avenue South between South 170th Street and South 172nd Lane currently is located within the boundaries of unincorporated King County.
4. It is in the city's, the county's and the adjacent property owners' best interest to have this right-of-way wholly within the city's jurisdiction for the administration of construction projects, maintenance and permitting.
5. The city approved ordinance number 2354 to revise its corporate boundary at 53rd Avenue South to include all of 53rd Avenue South between South 170th Street and South 172nd Lane.
6. RCW 35.21.790 authorizes "the governing bodies of a county and any city or town located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefore a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."
7. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35.21.790.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The revision of the corporate boundary of the city of Tukwila to fully include the right-of-way for 53rd Avenue South between South 170th Street and
South 172nd Lane, legally described as set forth in Attachment A to this ordinance, is hereby approved.
