      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Ordinance 14517, Section 118, as amended by adding thereto and inserting therein the following:
      From several capital improvement projects fund there is hereby appropriated and authorized to be disbursed the following amounts for the specific projects identified in Attachment I to this ordinance.

      PROVIDED THAT:
      The appropriation for the transit control center replacement project, project A00532 is subject to the following requirements:
      A.  The executive shall submit to the budget and fiscal management committee or its successor a report detailing the structural seismic design criteria to be utilized in the design of the transit control center project.  The report shall include a summary of the seismic design as required by the Seattle Building Code and International Building Code and identify all assumptions and basis for design under a performance based design process.  The report shall further describe the design strategies to ensure continual and immediate occupancy of the communications center in the event of liquefaction of the soils during a major seismic event on the Seattle Fault or other seismic fault.  The report shall describe the design strategies to mitigate damage to utilities and site access to ensure that the communications center will remain operational during a major seismic event.  The report shall be prepared for review by an independent structural engineer.
      B.  The executive shall submit to the budget and fiscal management committee or its successor, a monthly written report as to the status of the project identifying ongoing and resolved issues including scope, schedule, and budget.  The report shall include a comparison of actual monthly expenditures with planned expenditures and an explanation of material deviations from planned expenditures.  Executive staff will be available to present the report if requested by the chair of the budget and fiscal management committee or its successor.
      C.  The executive shall engage the services of an independent oversight monitoring consultant to review the progress of the transit communications center project.  The proposed oversight monitoring consultant individual or firm shall be submitted to the chair of the budget and fiscal management committee or its successor for approval.  The scope of work for the oversight monitoring consultant will be to provide project monitoring of compliance with generally accepted project management practices to include scope, schedule, and budget during all phases of the project design and construction and comments on schedule compliance and opinion on ability of the project to achieve its completion date.  The oversight monitoring consultant shall also engage the services of a structural engineer experienced in seismic design, and approved by the chair of the budget and fiscal management committee, to review and report on the seismic design report prepared by the project engineer of record.  Monthly reports shall be transmitted to the chair of the budget and fiscal management committee or its successor concurrent with the project monthly reports.  The oversight monitoring consultant shall be available to report to the budget and fiscal management committee or its successor not more than quarterly.  Within fifteen days of receipt of monthly reports, the chair of the budget and fiscal management committee or its successor may review the monthly reports; determine if issues warrant suspension of project expenditure authority; and by letter, request the executive to remedy the identified problems or suspend project spending.
      SECTION 2.  Attachment I to this ordinance hereby amends Attachment B to
 
Ordinance 14517, as amended, by adding thereto and inserting therein the projects listed in Attachment I to this ordinance.
