AN ORDINANCE authorizing the vacation of a portion of 48th Ave S/Nebraska Ave in the Jovita area of unincorporated King County, V-2775; Petitioners: Vasiliy Chebotarev and Scott Stevens.

STATEMENT OF FACTS:
1. A petition has been filed requesting vacation of a portion of 48th Ave S/Nebraska Ave in the Jovita area of the West King County Community Service Area of unincorporated King County, hereinafter described.
2. The department of local services notified utility companies serving the area and King County departments of the proposed vacation. Puget Sound Energy and Lumen responded. None of the responding utility providers had facilities within the area and there were no objections or stipulations. The vacation shall not extinguish the rights of any utility company to any existing easements for facilities or equipment within the vacation area.
3. No properties rely upon this right of way for access.
4. The department of local services's records indicate that this segment of right-of-way is unopened and unmaintained.
5. The department of local services considers the subject portion of right of way useless as part of the county road system and believes the public would benefit by the return of this segment of right of way to the public tax rolls and recommends approval of the vacation.
6. Pursuant to K.C.C. 14.40.020 and RCW 36.87.120, the value of the vacation area is offset by the costs to King County to manage and maintain this segment of unopened right of way and the present value of future property tax resulting in: a determination of no compensation required for the vacation of approximately 6,800 square feet of 48th Ave S/Nebraska Ave right of way to the property of petitioners Vasiliy & Olga Chebotarev, identified by King County assessor's Parcel Numbers 375160-5079 and 375160-5093; and a determination of no compensation required for the vacation of approximately 4,800 square feet of 48th Ave S/Nebraska Ave right of way to the property of petitioners Scott and Susan Stevens, identified by King County assessor's Parcel Numbers 375160-5131 and 375160-5141.
7. Due notice was given in the manner provided by law. The office of the hearing examiner held the public hearing on ________, ______, 2026.
8. As detailed in the _________, ___ 2026, recommendation, the hearing examiner found that the road segment subject to this petition is not useful as part of the King County road system, concluded that the vacation of this segment of road will benefit the public through the transfer of responsibility for management and recommended approval of the vacation petition.
9. For the reasons stated in the examiner's ____________, ____ 2026, report and recommendation, the council determines that it is in the best interest of the citizens of King County to grant said petition and vacate the right of way.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The council, on the effective date of this ordinance, hereby vacates and abandons a portion of 48th Ave S/Nebraska Ave, right of way as described below:
That portion of the Northeast Quarter of the Southeast Quarter of Section 27, Township 21 North, Range 4 East, W.M, in King County, Washington described as follows:
Beginning at the intersection of the northerly right-of-way margin of South 364th Street and east line of Block 117 of Jovita Heights as recorded in Volume 20 of Plats, page 12, records of King County, Washington;
Thence easterly along said margin to the southwest corner of Block 116 of said Plat;
Thence northerly along the west line of said Block 116 to the northwest corner of Lot 9 of said Block 116;
Thence easterly along the northerly line of said Lot 9 to a line 10.00 feet east of and parallel with said margin;
Thence northerly along said parallel line to the northerly line of Lot 8 of said Block 116;
Thence westerly along said northerly line to its intersection with the centerline of 48th Avenue South;
Thence southerly along said centerline to its intersection with the easterly prolongation of the northerly line of Lot 15 of said Block 117;
Thence westerly along said prolongated northerly line to the northeast corner of said Lot 15;
Thence southerly along the east margin of 48th Avenue South to the Ture Point of Beginning.
Containing approximately 11,600 square feet
SECTION 2. Recording of the approved vacation is contingent on delivery of $________________ to King County within ninety days of the date of enactment of this ordinance.
