Title

AN ORDINANCE authorizing the vacation of a portion of 149th Avenue SE and portions of King County Road Nos. 949, 1182, 1244, and 23-23-5-4, lying between the Cedar River and the existing cul-de-sac limits for 149th Avenue SE north of Maple Valley Highway, V-2771; Petitioner: King County department of natural resources and parks water and land resources division.

STATEMENT OF FACTS:

1.  A petition has been filed requesting vacation of a portion of 149th Avenue SE and portions of King County Road Nos. 949, 1182, 1244, and 23-23-5-4, lying between the Cedar River and the existing cul-de-sac limits for 149th Avenue SE north of Maple Valley Highway in the West King County Community Service Area of unincorporated King County, hereinafter described.

2.  The department of local services notified utility companies serving the area and King County departments of the proposed vacation. Puget Sound Energy, Lumen, and Cedar River Water and Sewer District responded. None of the responding utility providers had facilities within the area and there were no objections or stipulations.  The department of local services has stormwater pipes and drainage outfalls within the proposed vacation area and requests that King County department of natural resources and parks water and land resources division assume ownership and maintenance responsibilities in conjunction with the vacation, if approved.

3.  The department of local services's records indicate that this segment of right-of-way is no longer opened and is unmaintained.

4.  The department of local services considers the subject portion of right-of-way useless as part of the county road system and believes the public would benefit by the transfer of stewardship to an agency better equipped for its management and recommends approval of the vacation.

5.  Pursuant to K.C.C. 14.40.020 and RCW 36.87.120, the value of the vacation area is offset by the costs to King County to manage and maintain this segment of unopened right-of-way. As this is a transfer among King County agencies, the property will not be returned to the tax rolls.

6.  Due notice was given in the manner provided by law.  The office of the hearing examiner held the public hearing on ________, ______, 2026.

7.  As detailed in the _________, ___ 2026, recommendation, the hearing examiner found that the road segment subject to this petition is not useful as part of the King County road system, concluded that the vacation of this segment of road will benefit the public through the transfer of responsibility for management and recommended approval of the vacation petition.

8.  For the reasons stated in the examiner's ____________, ____ 2026, report and recommendation, the council determines that it is in the best interest of the citizens of King County to grant said petition and vacate the right-of-way.

                     BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:

                     SECTION 1.  The council, on the effective date of this ordinance, hereby vacates and abandons a portion of King County Road Nos. 949, 1182, 1244, and 23-23-5-4 right-of-way as described below:

All those portions of Elliott Bridge No. 2 Road (King County Road No. 949), Jones Road (King County Road No. 1182), abandoned King County Road No. 1244, and Elliott Bridge Relocation Road (King County Road No. 23-23-5-4), Also known as 149th Avenue Southeast, lying southerly of the Cedar River and lying northerly of the following described line:

Commencing at the west quarter corner of Section 23, Township 23 North, Range 5 East, W.M., said corner being a scribed "X" in stone 1.5 feet below grade and having a Washington State Plane North Zone NAD 83/91 coordinate value of N.173074.34, E.1316563.79 per King County Survey Database point number 3778;

Thence N00°20'12"E, a distance of 382.58 feet to a point on the west line of said Section 23, said point bearing S00°20'12"W, a distance of 2139.16 feet from the northwest corner of said Section 23, said corner being a 3" brass disk set in concrete and having a Washington State Plane North Zone NAD 83/91 coordinate value of N.175596.03, E.1316578.61 per King County Survey Database point number 3765;

Thence S 89°39'48" E, a distance of 200.74 feet to a point on the northwesterly right-of-way margin of 149th Avenue SE at the intersection with the westerly line of Road No. 949 as deeded to King County under Recording No. 820283, said point being the True Point of Beginning of the herein described line;

Thence across said deeded right-of-way, N 21°25'05" E, a distance of 74.65 feet to the intersection of its easterly boundary with a line parallel with and offset 2.4' southerly of the cul-de-sac right-of-way line as deeded to King County under Recording No. 20031219001122;

Thence along a line parallel with and offset 2.4 feet southerly of said deeded cul-de-sac, N 79°06'58" E, a distance of 7.37 feet to the beginning of a curve the right having a radius of 60.00 feet;

Thence along said curve to the right, a distance of 98.0 feet, more or less, to the intersection with the easterly line of 149th Avenue SE as surveyed by King County Survey No. 23-23-5-4, and the terminus of the herein described line.

Said roads having a combined length of approximately 730 feet (0.14 miles).
