AN ORDINANCE authorizing the King County wastewater treatment division of the department of natural resources and parks to enter into an agreement with Soos Creek Water and Sewer District regarding the joint use, construction and maintenance of district improvements.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. The Soos Creek Water and Sewer District currently provides local sewer collection services to approximately thirty-seven thousand customers.
B. Under a 1990 long-term agreement with the city of Black Diamond, the county is required to operate, maintain, and repair the regional conveyance and treatment facilities, including the Black Diamond Trunk (large sewer line), to serve the county's regional wastewater service area, which includes Black Diamond.
C. In 2006, the county and Soos Creek Water and Sewer District entered into an agreement whereby the Soos Creek Water and Sewer District agreed to convey sewage from the county's Black Diamond Trunk through the Soos Creek Water and Sewer District's facilities to the county's regional conveyance system.
D. The county is required by state law to plan for wastewater conveyance and treatment facilities of adequate capacity to meet the needs of existing customers and planned growth in its regional service area.
E. The Soos Creek Water and Sewer District constructed its Lift Station 11B and Lift Station 10B with sufficient capacity to accommodate the Soos Creek Water and Sewer District's projected future sewer capacity needs and the county's potential increased capacity demands in Black Diamond. Lift stations are used to pump wastewater from a lower to a higher elevation.
F. Based on the current estimated planning level cost of sixty million dollars for the county to upgrade its conveyance system to serve Black Diamond as compared to an estimated cost of twenty-four million dollars for the county's capital cost share to use district facilities, it is more efficien...
