Title

A RESOLUTION relating to the opportunity fund, establishing a policy for the expenditure of opportunity funds by jurisdictions that are located in both King County and an adjacent county, and adding a new section to Resolution FCZD 2008-10.2. 

Body

                     WHEREAS, in Sections 1, 4, 5, 6, 7 and 8 of Resolution FCZD 2008-10.2, Section 1 of Resolution FCD 2010-33.1, Section 1 of Resolution FCD 2012-13.1, and Section 2 of Resolution FCD 2013-20.1, the Flood Control Zone District ("District") board of supervisors created the subregional opportunity fund, now known as the "opportunity fund," and established rules, regulations and policies for the opportunity fund; and

                     WHEREAS, in Resolution FCD 2009-02.1 and Sections 2 and 3 of Resolution FCD 2012-13.1, the board of supervisors approved a form of interlocal cooperation agreement ("Agreement") for opportunity fund projects, and authorized the executive director to sign such form Agreement with participating  jurisdictions; and

                     WHEREAS, the board of supervisors desires to establish a new policy for the expenditure of opportunity funds by jurisdictions that are located in both King County and an adjacent county; now, therefore

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:

                     SECTION 1.  A new section is hereby added to Resolution FCZD 2008-10.2 to read as follows:

Participating jurisdictions that are located in both King County and an adjacent county must expend opportunity funds on Projects, as that term is defined in the Interlocal Agreement between the District and the participating jurisdiction, that benefit King County residents.  At the request of the District or the water and land resources division of the King County department of natural resources and parks, the participating jurisdiction must provide evidence that it will satisfy or has

satisfied this requirement.
