AN ORDINANCE authorizing the county executive to execute interlocal agreements between King County and the cities in King County, the Port of Seattle, the University of Washington, Metro and Sound Transit for electronic fingerprint capture equipment services.

STATEMENT OF FACTS:
1. The cities of Algona, Auburn, Bellevue, Black Diamond, Bothell, Burien, Des Moines, Duvall, Enumclaw, Federal Way, Issaquah, Kent, Kirkland, Lake Forest Park, Maple Valley, Mercer Island, Milton, Pacific, Redmond, Sammamish, SeaTac, Seattle, Shoreline, Snoqualmie, Tukwila and Woodinville, the Port of Seattle and the University of Washington currently use Livescan fingerprint capture stations provided by the King County regional automated fingerprint identification system ("AFIS") program.
2. The AFIS program also distributed fourteen mobile handheld fingerprint capture devices in 2013 as part of a pilot program with Bellevue, Bothell, Burien, Federal Way, Issaquah, Kent, Kirkland, Maple Valley, Metro Transit, SeaTac, Seattle, Sound Transit and Tukwila police departments. A permanent program to be implemented in 2014 will distribute an additional two hundred to two-hundred and fifty devices to police agencies throughout the county.
3. The use of the equipment is currently not governed by any written interlocal agreement.
4. The county desires to memorialize the terms of use of the equipment in an interlocal agreement with the jurisdictions that are using or will be using the equipment.
5. Participation in interlocal agreements for the use of the equipment is to the benefit of the citizens of King County, as the equipment is purchased with King County levy-funded dollars.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY
