AN ORDINANCE approving a sewer franchise for the city of Kent, Washington, located in council district five.

STATEMENT OF FACTS:
1.  The city of Kent filed an application for a sewer franchise to operate and maintain sewer pipelines and appurtenant facilities in unincorporated King County for the purpose of providing sewer service in King County.
2.  The city of Kent's Sewer Comprehensive Plan was approved by the King County council in accordance with a recommendation of the King County utilities technical review committee.
3.  The utilities technical review committee has approved the city of Kent's franchise application as meeting the requirements of K.C.C. 6.27.060 and 13.24.010.
4.  The council has scheduled, noticed and conducted a public hearing regarding the city's application for a right-of-way franchise on the 2nd day of September, 2014, as required by RCW 36.55.040 and K.C.C. 6.27.050.
      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:      
      SECTION 1.  The metropolitan King County council, having determined that the City of Kent's application meets the criteria for the granting of a sewer franchise and that the grant is in the best interests of the public, does hereby approve the attached franchise agreement and authorizes the King County executive to execute the agreement.
      If within forty-five days after the granting of the franchise, the applicant fails to sign the written acceptance incorporated in this ordinance, then the rights and privileges granted in this ordinance shall be forfeited and the franchise shall be null and void.
      If this franchise is accepted by the applicant as provided herein and comes into force and effect, then this franchise shall replace the association's previous sewer
franchise, specifically No. 1648, 5303 and 1118 such earlier franchise shall be thereafter null and void.
