AN ORDINANCE approving an updated water franchise for the city of Carnation, Washington, located in council district three.

STATEMENT OF FACTS:
1. The city of Carnation filed an application for an updated water franchise to operate and maintain a water supply system within its Water Planning Area, which includes a consolidated legal description approved in 2009.
2. Carnation's Comprehensive Water System Plan was approved by the King County council in accordance with a recommendation of the King County utilities technical review committee by Ordinance 16526, enacted June 30, 2009,
3. The utilities technical review committee has approved the city's franchise application as meeting the requirements of K.C.C. 6.27.060 and K.C.C. 13.24.010.
4. The council has scheduled, noticed and conducted a public hearing regarding the city's application for a right-of-way franchise on the _________ day of _________, 2014, as required by RCW 36.55.040 and K.C.C. 6.27.050.
BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. The metropolitan King County council, having determined that the city of Carnation's application meets the criteria for the granting of a water franchise and that the grant is in the best interests of the public, does hereby approve the attached franchise agreement, which is Attachment A to this ordinance, and authorizes the King County executive to execute the agreement.
If within forty-five days after the granting of the franchise, the applicant fails to sign the written acceptance incorporated in this ordinance, then the rights and privileges granted in this ordinance shall be forfeited and the franchise shall be null and void. If the franchise is accepted by the applicant as provided herein and comes into force and effect, then this franchise shall supersede the city's three previous water franchise or franchises,
specifically No. 445, No. 2651 and No. 6022, and such earlier franchise or franc...
