A RESOLUTION relating to the Russell Road Upper Levee-North and South Reach levee improvement project on the Green River in the City of Kent, and authorizing the chair to enter into an agreement with the City of Kent.
Body
WHEREAS, by Resolution FCD 2013-12.1, adopted on July 17, 2013, the King County Flood Control District Board of Supervisors ("District") approved the "Agreement for Levee Construction, Operation and Maintenance for the Russell Road Upper Levee-North Reach, River Mile 19.5 to 19.8, Right Bank" between the District and the City of Kent ("North Reach Agreement"); and
WHEREAS, the District and the city of Kent have implemented in part the North Reach Agreement; and
WHEREAS, by Resolution FCD 2012-09.3, adopted on November 5, 2012, and FCD 2013-14.3, adopted on November 12, 2013, the District approved funding for the North Reach and a portion of the South Reach of the Russell Road Upper Levee improvements; and
WHEREAS, construction of the Russell Road Upper Levee-North Reach and South Reach improvements is intended to achieve levee certification on the Green River between river mile 19.25 to 20.4, right bank; and
Whereas the District desires that all maintenance activities performed under this resolution shall be consistent with vegetation management plans approved through the Green River SWIF; and
WHEREAS, the District desires to authorize the chair of the District to enter into an agreement between the District and the city of Kent relating to the rights and duties of the respective jurisdictions for implementation of the levee improvements described in this resolution; now, therefore
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KING COUNTY FLOOD CONTROL ZONE DISTRICT:
