AN ORDINANCE authorizing the King County executive to execute an amendment to the interlocal agreement with the King County flood control zone district extending the duration of the interlocal agreement through December 31, 2014.

      BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
      SECTION 1.  Findings:
      A.  On February 17, 2009, King County ("the county") and the King County flood control zone district ("the district") entered into an interlocal agreement ("the ILA"), as authorized by King County Ordinance 16341 and District Resolution FCD2008-17.1, whereby the county as service provider to the district would provide flood protection services and implement the district's annual work program and budget.  The ILA originally had a termination date of December 31, 2010.
      B.  The ILA has been amended by the district and the county three times; the first occurred in 2009 and authorized advance payment for services.
      C.  In 2010, the second amendment to the ILA amended Section 13.1 of the ILA to allow the district to extend the term of the ILA once for a two years by giving notice of extension to the county on or before December 31, 2010.  The ILA was subsequently amended in 2012 through the third amendment to extend the term of the ILA through December 31. 2013.
      D.  The county and the district agree that Section 13.1 of the ILA should be further amended to extend the term of the ILA through December 31, 2014.
      E.  The fourth amendment to ILA, Attachment A to this ordinance, amends the ILA to extend the term of the ILA through December 31, 2014.
      SECTION 2.  The county executive is hereby authorized to execute an
amendment to the ILA substantially in the form of Attachment A to this ordinance.  All other provisions of the ILA shall remain in full force and effect.
