STATEMENT OF FACTS:
1. The city of Duvall owns sewer and water infrastructures within the Duvall-Monroe Road Northeast and Cherry Valley Road rights-of-way.
2. Residential and commercial parcels within the city limits are located along Duvall-Monroe Road Northeast and Cherry Valley Road.
3. These segments of Duvall-Monroe Road Northeast and Cherry Valley Road rights-of-way serve city residents as well as commercial properties.
4. The city and the county agree that these segments of Duvall-Monroe Road Northeast and Cherry Valley Road rights-of-way should be in the city's jurisdiction.
5. It is in the city's and the county's best interest to have these rights-of-way under the city's jurisdiction, so that the city may provide local services to its residents related to the maintenance and operation of the road rights-of-way.
6. The city approved resolution number 13-01 to revise its corporate boundary at Duvall-Monroe Road Northeast and Cherry Valley Road to include the unincorporated segments of the public rights-of-way within the corporate limits of the city.
7. RCW 35A.21.210 authorizes "the governing bodies of a county and any code city located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right-of-way by substituting therefor a right-of-way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."
8. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority as provided for in RCW 35A.21.210.
