AN ORDINANCE revising the corporate boundary of the city of Kirkland to include portions of Northeast 155th Street and 116th Avenue Northeast rights-of-way as provided for in RCW 35.21.790.

STATEMENT OF FACTS:
1. The Juanita/Finn Hill/Kingsgate annexation to the city of Kirkland took effect on June 1, 2011.
2. It was discovered that portions of Northeast 155th Street and 116th Avenue Northeast rights-of-way were excluded from the Juanita/Finn Hill/Kingsgate annexation.
3. The cities of Kirkland and Bothell agree that portions of Northeast 155th Street and 116th Avenue Northeast rights-of-way should be within the city of Kirkland's jurisdiction and not the city of Bothell's jurisdiction because the rights-of-way serve city of Kirkland residents.
4. It is in the city's and the county's best interest to have these rights-of-way under the city's jurisdiction so that the city may provide local services to its residents.
5. The city of Kirkland approved ordinance number O-4324 to revise its corporate boundary at Northeast 155th Street and 116th Avenue Northeast to include portions of the rights-of-way.
6. RCW 35.21.790 authorizes "the governing bodies of a county and any city or town located therein may by agreement revise any part of the corporate boundary of the city which coincides with the centerline, edge, or any portion of a public street, road or highway right of way by substituting therefor a right of way line of the same public street, road or highway so as fully to include or fully to exclude that segment of the public street, road or highway from the corporate limits of the city."
7. Revision of the corporate boundary of a city is effective upon approval by the city council and the county legislative authority, as provided for in RCW 35.21.790.
