AN ORDINANCE authorizing the King County executive to enter into an interlocal agreement with Kittitas county related to solid waste management services for the Snoqualmie Pass Rural Town located in unincorporated King County.

BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
SECTION 1. Findings:
A. King County is authorized to manage municipal solid waste generated and collected within the unincorporated areas of its jurisdiction including designating disposal sites pursuant to chapters 36.58 and 70.95 RCW, K.C.C. Title 10 and the 2001 Comprehensive Solid Waste Management Plan.
B. Historically, a solid waste drop box has been located in the Snoqualmie Pass Rural Town located in unincorporated King County adjacent to the western border of Kittitas county. Approximately thirty-four residences use that solid waste drop box year-round. Historically, solid waste from that drop box has been collected by Waste Management of Ellensburg and disposed through Kittitas county's solid waste management system because that disposal site is closer for the Snoqualmie Pass Rural Town community than other disposal sites located within King County's solid waste management system.
C. By designating Kittitas county's solid waste management system for receipt and disposal of the small amount of solid waste generated and collected at the drop box, King County is formalizing the existing solid waste management practice that has existed for many years. Additionally, pursuant to state law, when solid waste is collected by a private hauler operating under a state franchise to collect solid waste in a geographic area lying in more than one county, the two counties must enter into an agreement regarding disposal of the waste.
D. King County and Kittitas county have agreed to work cooperatively to plan for and manage the solid waste generated in the Snoqualmie Pass Rural Town. Accordingly, King County and Kittitas county have negotiated and dr...
